Advice on Legal Procedure for buying a Property in Turkey
It is not necessary to appoint a solicitor for house purchases in Turkey
but it is the sensible thing to do for a few good reasons;
It will save you traveling there just to sign a few papers.
Procedure will be followed efficiently by a legal professional
on your behalf, who speaks in the native tong.
Anything that may cause problems later on will be eliminated
or flagged up.
As it will be an English speaking solicitor it will save you hiring
an official translator.
It will not cost you a fortune, it will be money well spent.

Contract Details:
Contract should include the following details
A detailed description of the property. ie. Full address, Tapu details (Title deed)
The actual price to be paid to the seller. (Buyer and the seller will each pay a stamp duty of 0.75% of the stated value) Having the value of the property stated
in the contract will help to protect your rights in case of a future dispute.
The bank account details of the seller. It should be a single account, which all
the payments should be made in to.
The bank account details of the professional you are using. You should use a single account to make payments into this account.
The payment terms and conditions, including the details of deposit, interim and final payments to the seller as well as the payment details to the agent and the solicitor would have to be separately identified.
Details of the tax liabilities.
The fees and commissions to be paid agent and the solicitor
Whether parties can back out of the sale/purchase, if so under what conditions can this happen.
What happens if there is a legal obstacle
Under what conditions and how will the money would be refunded. |
